Aquila Terms and Conditions of Sale
- DEFINITIONS

“Aquila” means Aquila Computer Systems Ltd, based at 27-28 King Street, Weymouth, Dorset DT4 7BQ.

“The Customer” means the person, firm or company ordering or buying goods from Aquila.
- “Products” and/or “Goods” means the goods or services including but not limited
to computer hardware and software items to be provided by us to the Customer in
accordance with these terms.
- GENERAL
-
All products come with a 12 month warranty from date of purchase, unless otherwise
stated. Manufacturer warranty periods longer than this, are to be handled by the
manufacturer and the Customer must deal with the relevant manufacturer directly.

These terms are governed by the laws of England and Wales and any disputes will
be decided only by the courts of England and Wales.
- Aquila reserve the right to change these terms at any time without prior notification.
- ORDERS
-
All orders placed by the Customer for Products shall constitute acceptance of these
terms and no amendment to these terms or subsequent terms shall be binding unless
agreed in writing by Aquila.
- Aquila reserves the right to accept or decline any order for Products from the Customer
for any reason.
- PRICING

Whilst we endeavour to ensure the prices on our website are as accurate as possible,
we reserve the right to change a price in exceptional circumstances. If a price
is corrected due to exceptional circumstances, the Customer will be informed of
the change before the Goods are despatched and will be offered the opportunity to
cancel the order.

If an order is placed for an item with an erroneous price, and the erroneous price
is less than the cost price of the Goods, we reserve the right to process the order
at cost price or offer a full refund to the Customer.
- In the event that a Product is unavailable (has either been discontinued by Manufacturer
or has long lead times) Aquila may offer an alternative product to the Customer.
We will normally contact the Customer before any alternative is despatched.
- PAYMENT TERMS

Payment must be received in full before Goods are despatched.

All goods remain the property of Aquila until payment has been received in full.
- Your credit card will be charged on the day the order is accepted by our online
store.
- RETURNS POLICY
-
If your Goods arrive faulty or damaged, or a fault becomes apparent in the first
7 days after delivery, we will either provide a full refund or dispatch new Goods
as soon as possible, after the faulty Goods have been returned to us. A minimum
restocking fee of 15% may be applicable if any goods are returned incomplete or
damaged (including but not limited to missing manuals, CD's, damaged/missing retail
packaging etc.). Returns will not be issued as a result of compatibility problems.
In the event of compatibility problems, the item will be considered to be an unwanted
Product.

If your Goods are not faulty, but you simply do not want them, you have 7 days (Cooling-off
period) from the day of receipt of the Goods to cancel the order and return the
Goods for a refund. A refund will be provided within 30 days of us receiving the
unwanted Goods. Returning of unwanted Goods is the responsibility of the Customer,
otherwise collection costs of the unwanted Goods will be deducted from the refund.
Postage and Packing charges are a separate contract and are deemed as a service
that has begun and has been completed before the end of the 7 day cooling-off period
and hence will not be refunded.

Unwanted goods returned after the 7 day cooling-off period will be liable to a 10%
restocking fee.

All unwanted Goods must be returned to us in a resaleable condition (i.e. manufacturers
packaging must be undamaged and unopened, all manuals, CDs etc must be enclosed).
In the event that unwanted Goods are not returned in a resaleable condition, the
Goods will be returned to the Customer at their cost and subject to a £25 (exc VAT
& Postage) charge.

If unwanted Goods are returned to us more than 30 days from the date of purchase
any credit given will be based on the Items current market value (if this is lower
than the original sale price). Any such credits are subject to a 10% restocking
fee.

In the event that a returned Product is no longer stocked by us and is irrepairable
/ irreplaceable, you may be offered an alternative / higher specification device
at extra cost to you, or a full refund.

It is the responsibility of the Customer to ensure safe delivery of any returned
Product to Aquila.

Warranty stickers must be intact on any Products returned to us. Aquila reserve
the right to refuse credit/replacement for any Product that has had the warranty
sticker removed or tampered with.

Any returned Products that have been obviously damaged, modified or are incomplete
will be returned immediately, incurring a £25 (exc. VAT & Postage) charge (including
but not limited to broken cases/cores on processors, memory modules with heatsinks
fitted/removed, damaged pins, damaged motherboards due to incorrect fitting etc.)

Aquila will not be held responsible for damaged processor cores due to incorrect
cooler installation. Overheated cores will not be replaced under any circumstances.
AMD & Intel no longer recommend using cooler paste as too much or too little
paste can cause overheating. Therefore the best option is to apply heat sink pads.
All traces of old cooler paste or pad must be removed before a new pad is applied.

Any Product returned as faulty and found to contain no fault will be subject to
a £25 (exc. VAT & Postage) charge and it will be returned to the Customer.

All computer systems and items specifically built by request are subject to a 20%
cancellation fee once the build has been initiated. Any relevant build service costs
will also be incurred.

Aquila will not accept returned Goods without a returns number. To obtain a returns
number send an email to support@aquila.to quoting your name, address, invoice number,
description of the item and a full description of the problem. Please also include
a daytime telephone number in the event that our technicians need to speak to you
direct. We endeavour to respond to all support requests within 5 working days. If
our technical team agree to accept the return you will be issued with a returns
number. This must be clearly shown on all Goods returned to us. Do not deface the
manufacturers original packaging with either the returns number or the return address.
- Under no circumstances will the original carriage charge be refunded for unwanted
or non faulty Goods.
- ORDER DELIVERY & CANCELLATION

All orders should be checked immediately upon receipt. Shortages or damaged items
must be reported within 24 hrs of receipt.

If your Goods fail to arrive within 28 days of dispatch, you will have the option
of either a full refund or a replacement shipment.

Where an incorrect address has been given to Aquila we reserve the right to charge
for any extra carriage costs incurred.
- You have the right to cancel your order at any time before receipt of Goods. If
you cancel your order before Goods have been dispatched, you will be refunded in
full. If you cancel after Goods have been dispatched, you will be refunded less
shipping charges as the shipping contract is deemed to have been initialised.
- PRIVACY

We collect the information given at the time of your order. This information is
not disclosed to any third party and is only collected by Aquila for the purpose
of processing orders, tracking orders or tracing Warranty/Returns information.

We do not email customers except in connection with your order, you will receive
no newsletters, special offers or other spam, unless requested by you.
- All information is collected lawfully and in accordance with the Data Protection
Act 1998.
- V.A.T (SALES TAX)

All prices on our web site are shown both exclusive of V.A.T and inclusive of V.A.T.
- For all customers VAT is charged at 17.5%. Documentation is enclosed with the goods
to confirm that VAT has been charged.
- DESPATCH INFORMATION

Goods will normally be dispatched within 3 working days of order placement. In the
event that an item is out of stock Customers will normally be notified of the delay
within 1 week from order placement.

Customers will be notified by email once Goods have been dispatched.

Aquila use either Royal Mail recorded or special delivery service, and Initial City
Link courier service for the shipping of Goods. You will be notified by which method
your item has been sent when we email you to advise of dispatch.

All these services are ‘signed for’ services i.e. you must be available to sign
for your Goods upon delivery.

Initial City Link will endeavour to deliver the item on two consecutive working
days. In the event that they are unable to deliver the Goods, the Goods will be
held at you local depot for a further 5 days. During this time you must contact
your local depot and arrange re-delivery (any additional costs to be incurred by
you) or arrange collection from your local depot. If you do not contact Initial
City Link during this time your Goods will be returned to us. If you request that
the Goods be re-shipped after they have been returned to us, Aquila reserve the
right to charge any additional carriage costs incurred. In the event that you cannot
contact your local Initial City Link depot, please contact us before the Goods are
returned to us.

In the event that you wish to change the delivery address after the Goods have been
dispatched Aquila reserve the right to charge any additional carriage costs incurred.
- In the event that you wish to have your parcel left with a neighbour you must contact
us in writing with full details of your neighbours address. Aquila is not able to
accept responsibility for any missing Goods left with a neighbour.
- COMPLAINTS

We endeavor to reply to any complaints within a 7 day period.
- Please send any complaints in writing to Aquila Computer Systems Ltd marked "Complaints
Department" and mailed to our registered address. 27-28 King Street, Weymouth, Dorset DT4 7BQ
